Falling and failing could pretty much mean the same thing in this context.
A pretty well-known example:

-Makes Cube look like the typical greedy server
-People will believe that appeals are always denied so people buy unmutes

I don't agree, because it's your own mistake if you're muted.
No single mod gives you a fake mute, because you need evidence.

You get warnings before you are muted. If people don't learn, then its a perm mute and its your own fault for not reading the rules in the first place.
